Acceptance of terms of use

These Terms of Use govern your use of the content and services offered through Gaminar.net (the "Site"). By using the Site, you (the "User") agree to be bound by these Terms of Use. You certify that you are at least 18 years of age, or, if you are under 18, that you have the consent of your parent or legal guardian.

Gaminar.net may update these Terms of Use from time to time as it deems fit. You are responsible for checking them periodically. Your use of the Site after any amendment constitutes your acceptance of the revised terms.

We, as a merchant, shall be under no liability whatsoever with respect to any loss or damage arising directly or indirectly out of the decline of authorisation for any transaction on account of the cardholder having exceeded the pre-set limit mutually agreed by us with our acquiring bank from time to time.

Definitions

"Account" refers to the User account created free of charge for using the Site.
"Gaminars" refers to the goods and services displayed on the Site and offered for sale or use under "Gaminars Ready to Use" and "Gaminars Customisable".
"Simulations" refers to the goods and services displayed on the Site and offered by external content providers.
"Site" refers to Gaminar.net, owned and operated by Gaminar.net (Human Development Solutions DMCC).
"User" refers to the customer or buyer who registers on the Site and purchases or uses Gaminars.

Registration and credentials

Registration on the Site is mandatory to use the services.

The User is responsible for maintaining the confidentiality of their password and user ID, and is fully responsible for all activities that occur under them. The User agrees not to use any other party's user ID and password without proper authorisation, and to notify Gaminar.net immediately of any unauthorised use of their account. Gaminar.net is not responsible for any loss or damage arising from the User's failure to comply with this requirement.

The User agrees to (a) provide true, accurate, current and complete information as prompted by the registration form, and (b) maintain and promptly update that information. If any information is untrue, inaccurate, not current or incomplete, Gaminar.net may suspend or terminate the User's registration and refuse any current or future use of the Site.

The User grants Gaminar.net the right to disclose registration data to third parties to the extent necessary for the delivery of Gaminars.

The User understands that credits acquired at Gaminar.net have an expiration date of one year.

Simulations

Simulations are provided by external content providers. Gaminar.net is not responsible for their certification process, costs or user support. A User certified in a Simulation has access to it under the terms and conditions of the external provider, for which Gaminar.net cannot be liable. The external provider or Gaminar.net may remove a Simulation from the Site at any time, in which case the external provider is responsible for continuing to provide access on an alternative platform.

Payment details

In a card transaction you must use your own card. You confirm that the card details you provide are complete and accurate and that you will not use a card or bank account not lawfully owned by you. Payment details will not be shared with any third party except as required by law or to complete your purchase. Gaminar.net is not responsible for any loss resulting from misuse of your user ID, password or payment details.

Changes

Gaminar.net reserves the right to suspend, cancel, discontinue or modify any Gaminar description or other content displayed on the Site at any time without notice.

User's obligations

You are responsible for all activity under your account and for keeping your password confidential. You agree not to host, display, upload, modify, publish, transmit, update or share any information on the Site that:

belongs to another person and to which you do not have any right;
is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic or libellous;
is invasive of another's privacy, hateful, or racially or ethnically objectionable, disparaging, relating to or encouraging money laundering or gambling, or otherwise unlawful in any manner;
harms minors in any way;
infringes any patent, trademark, copyright or other proprietary rights;
violates any law for the time being in force;
deceives or misleads the addressee about the origin of such messages, or communicates any information which is grossly offensive or menacing in nature, or impersonates another person;
contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
threatens the unity, integrity, defence, security or sovereignty of any nation, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognizable offence;
posts, distributes or otherwise makes available or transmits any software or files that contain a virus, trojan horse, time bomb, bot, malicious content or any other harmful component;
deletes from the Site any legal notices, disclaimers or proprietary notices, or modifies any logos that you do not own or have permission to modify;
uses the Site in any manner that could damage, disable, overburden or impair any Gaminar.net server or network, or interfere with any other party's use of the Site;
obtains or attempts to obtain any materials or information through any means not intentionally made available through the Site;
impersonates any person or entity, including Gaminar.net officials, or falsely states or misrepresents your affiliation with a person or entity;
takes any action which encourages or consists of any threat of harm to any person or property, or carries out any denial-of-service attack on the Site;
makes any inappropriate, illegal or otherwise prohibited communication to any newsgroup, mailing list, chat facility or other internet forum;
uses the Site for illegal purposes, or disrupts, places unreasonable burdens on, or attempts unauthorised access to any Gaminar.net site or a customer's site;
transmits through the Site any unlawful, harassing, abusive, threatening, harmful, vulgar, obscene, hateful or otherwise objectionable material, or collects personally identifiable information of any person without their express written consent;
engages in antisocial, disruptive or destructive acts, including flaming, spamming, flooding, trolling and griefing;
forges headers or otherwise manipulates identifiers in order to disguise the origin of any content transmitted through the Site;
uploads, posts, emails or transmits any unsolicited advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes or any other form of solicitation;
encumbers or suffers to exist any lien or security interest on the subject matter of this agreement;
makes any representation or warranty on behalf of Gaminar.net.

Your right to use the Site is personal to you. You agree not to resell or make commercial use of the Site without the express written consent of Gaminar.net. You are solely responsible for the content of your transmissions, and your use of the Site is subject to all applicable local, national and international laws. Non-compliant content may be disabled or investigated, and we may terminate your account or block your access.

Disclaimer of warranties and liability

Your use of the Site is at your own risk. All content on the Site is for general information and does not constitute advice. Information is provided on an "as is" basis and all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement, are disclaimed. Gaminar.net does not warrant that descriptions, content or prices on the Site are accurate, complete, reliable, current or error-free.

Gaminar.net's entire liability to you shall be the refund of the money charged to you in respect of which the liability arises. Under no circumstances shall Gaminar.net be liable for any indirect, incidental, special, punitive or consequential damages, or any loss of profits, revenue or goodwill, suffered by you, your clients or your stakeholders.
